SUBJECT: Petition for legal regulation conditions on the area of village Kavran
Dear all!
The owners of the land in Kavran are recently received the board from construction inspection. With this board the inspection forbids us all further construction works on this piece of land. At the same time we have been invited to come to Pazin, where the note about the inspection work has been composed. Some of the owners have already received the written order from construction inspection with which they ably us to remove all the illegal buildings. Time limit for achieving written order is very short from 5 to 15 days, it depends of a written rule. Most of the owners are the citizens from Republic of Slovenia and Republic of Croatia.
Regarding all this matter we would like to point out for some historical facts:
- location in the past 20 years has been intensely used for the active holidays in the nature. On the whole location there is approximate 3000 parcel, with the average size between 400 and 600 m2, some of them are even smaller, their size is between 250 and 400 m2. All of these small parcels has become after splitting a few bigger lands around the year 1986 and has been registered with the ownership of several different persons. This was split in that way, that later on could the process of urbanism can be done.
- Most of the parcels are surrounded with stone walls. While organising the land a lot of soil was cart to this place. The owners built the buildings to stay there during vacation time.
- Some owners of the houses that were built in the year 2002 started the process of legalisation in year 2002 on the basis act 105. Zakona o dravni izmjeri i katastru nekretnina in Zakona o obem upravnem postupku, geodetski elaborat and send to Dravni geodetski upravi - in Pula. They got the written order "Obinskog suda u Puli, Dravne geodetske uprave Podrunog ureda for katastar Pazin, Ispostava Pula". After their written order the purpose of parcel "wood" has been changed to "weekend and backyard with weekend".
- With the organisation of the parcel and therefore using it regularly for the annually holidays and most of the weekends during the whole year, the village Karvan which is near, gained a lot out of it (market, restaurants). The village gained also a lot of opportunities for new working places for local people and possibilities for higher standard etc.
- In all of this time the owners of the parcel tried to legalise all buildings, but with no success. In this purpose the owners suggested a lot of incentive for resolving this matter to the community Marana, but they didn't accept their incentives. Through help of the lawyer owners passed the remarks during the process of acceptation new area plan in the year 2004 as well as in the year 2006. The area plan of community Marana was not accepted.
Because of all this we kindly ask you, that with your support and other possible measure help us maintain adjournment for written rule about demolition. The owners will also put in individually suggestions for prolong execute written rule, which we did or we will receive. We are sure that community Marana can with its influence and with its competence can help us. We are sure that the benefits out of this would have the community itself as well as the state. These benefits would the useful mainly:
- With solving the problem of illegal buildings the community would gain more organisations of the whole land and adjustment buildings with charistic architecture. With the regulation, what and how buildings should look like, the community could get the place that the whole Istria and community could be proud of. The owners would be forced to adjust their buildings to the regulated shapes and dimensions, which means the development the whole region.
After the legalisation of the illegal buildings the whole lands could have the appropriate infrastruction, which means more appropriate ecological solution then it is at the moment. The owners of the lands are willing to pay for all of this costs as well as for the costs of renovation the infrastrucion on the whole Kavarna region. As well we are prepared to pay for the settlement the road Kavarna - Budava.
- Out of the legalised and correctly evident real estate the community could get taxes. It could also be easier to take tourist tax for the time of staying there.
Beside all of this we are also expecting help because of the fact that all of the authorities in the last 20 years didn't do anything while all of this was going on. Firstly they let to split the big parcel into a lot of the smaller ones, for which was obviously that their area doesn't correspond to their usage because they were qualified as wood area. After that the competence organs assign the house number and change the description of the parcel in the cadastre and in land registry. Some of the owners get the bill to pay the tax which the owners paid several years. Activity and inactive of all competence state organs did show certain possibility to legalise illegal buildings in the future with which the owners were fooled. When we built this we were convicted that all this is to act in conformity with laws of Republic of Croatia. Not only that none of the organ tried to stop it for 20 years, they even follow our activity and encouraged us.
In the year 2002 they were preparing a new law in about the legalisation of the illegal buildings. We the informed about that through public publication in magazine Arena in May 2002. As regard on this article and interview with mister Kosteiem, we expect that the problem of the illegal building will be solved.
Because of all this we are kindly ask you to send us an answer.
Your point of view regarding all this and explain us all the further activity. We are appealing you to tell us, what plans do the community Marana has with all of this area, because right now we don't know what to do. We are asking you to postpone the demolition. We are asking for a dialog with the responsible people and inform us with all of the condition respectively with the conditions which has to be fulfil to legalise objects in the year 2007 where demolition is absurdity and unnecessary.
